Care Studios operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Care Studios is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.

Because many Care Studios products are individually handcrafted by artisans, slight variations in color, bead placement, pattern, shape, size, texture, wirework, and finish may occur from one piece to another. These variations are a natural part of handmade craftsmanship, contribute to the unique character of each item, and are not considered defects.

Product dimensions and weights shown on our website are approximate. Because our products are handcrafted, slight variations in size, weight, shape, and proportions may occur from one piece to another.

Certain Care Studios products are handcrafted in limited quantities, and some pieces may be one-of-a-kind or may vary from one production batch to another. As a result, an identical replacement may not always be available.

Custom, personalized, and made-to-order products may require additional production time. Estimated production and delivery dates are provided as guidance only and are not guaranteed. Once production of a custom or personalized item has begun, cancellation may not be possible. Returns and exchanges for custom, personalized, or specially commissioned products are subject to the exceptions set out in our Refund Policy.

We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be exactly the same as depicted or rendered in our online stores, particularly where natural variations occur as a result of handmade craftsmanship.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region, or jurisdiction, on a case-by-case basis.

SECTION 3 - ORDERS

When you place an order with Care Studios, you are making an offer to purchase the products in your order. Care Studios reserves the right to accept, decline, limit, or cancel an order at our discretion, including in cases of product unavailability, pricing or listing errors, suspected fraud, or other circumstances that may affect our ability to fulfill the order.

Your order is not considered accepted until Care Studios confirms acceptance and your payment has been successfully received and processed.

Please review your order carefully before submitting it. Because many Care Studios products are handmade, produced in limited quantities, or made to order, we may be unable to accommodate cancellation or modification requests after an order has been accepted or production has begun.

If we are unable to accept your order, need to make a change to your order, or cancel all or part of your order, we will make reasonable efforts to notify you using the email address, billing address, shipping information, and/or phone number provided at the time of purchase.

Availability of handmade and limited-production products may change without notice. If an item becomes unavailable after an order is placed, we may contact you to offer an alternative, issue a refund for the unavailable item, or cancel the affected portion of the order.

All returns and exchanges are subject to our Refund Policy, which is available on our website.

Unless otherwise expressly agreed with Care Studios, purchases made through our Shopify store are intended for personal or household use and not for commercial resale. Customers interested in purchasing Care Studios products for resale or wholesale purposes should contact us or use our designated wholesale sales channels.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions offered by Care Studios are subject to change without notice. The price charged for a product will be the price displayed at the time your order is placed and will be reflected in your order confirmation.

Unless otherwise stated, product prices do not include applicable taxes, shipping charges, customs duties, import fees, or other charges that may apply to your order.

Prices offered through the Care Studios Shopify store may differ from prices available through other sales channels, including wholesale platforms, exhibitions, markets, retail partners, or other third-party websites. Different sales channels may have different pricing, promotions, minimum order requirements, or terms.

From time to time, Care Studios may offer special promotions, discounts, or promotional codes. These offers may be subject to separate terms, limitations, expiration dates, or eligibility requirements. If the terms of a specific promotion conflict with these Terms of Service, the terms of that promotion will apply.

You agree to provide current, complete, and accurate purchase, billing, payment, shipping, and account information for all purchases made through our store. You are responsible for ensuring that your contact and payment information remains accurate so that we can process your order and contact you when necessary.

By submitting payment information, you represent that the information provided is accurate and that you are authorized to use the selected payment method. You agree to pay all charges associated with your order, including the product price, applicable shipping charges, taxes, and any other charges disclosed at checkout.

For international orders, additional customs duties, import taxes, VAT, brokerage fees, or other charges may be imposed by the destination country. Unless otherwise stated at checkout, these charges are the responsibility of the customer.

SECTION 5 - SHIPPING AND DELIVERY

Because many Care Studios products are handmade, most in-stock orders are prepared for shipment within approximately 8–10 business days.

Because our products are handmade in South Africa and we intentionally carry limited inventory, some items may need to be ordered directly from our artisans before they can be shipped to you. Care Studios generally receives artisan shipments from South Africa on a monthly basis, which may extend processing times for certain products.

If an item is not immediately available, we will make reasonable efforts to communicate the expected fulfillment timeline. Custom, made-to-order, and limited-production items may require additional time.

All processing, shipping, and delivery times provided by Care Studios are estimates only and are not guaranteed. Delivery times may be affected by shipping carriers, weather, customs processing, holidays, supply delays, or other circumstances outside our reasonable control.

Care Studios is not responsible for delays caused by shipping carriers, customs authorities, or events beyond our control. However, if your order appears to be lost, significantly delayed, or arrives damaged, please contact us so that we can assist you in determining the appropriate next steps.

Customers are responsible for providing a complete and accurate shipping address at the time of purchase. Care Studios is not responsible for delays or additional shipping costs resulting from incorrect or incomplete address information provided by the customer.

International shipments may be subject to customs inspections, import duties, taxes, or other charges imposed by the destination country. These charges and any resulting customs delays are outside the control of Care Studios and, unless otherwise stated at checkout, are the responsibility of the customer.

SECTION 6 - INTELLECTUAL PROPERTY

The Care Studios website and its content, including but not limited to the Care Studios name and logo, trademarks, text, written content, photographs, images, graphics, videos, audio, product descriptions, website design, and the selection and arrangement of such content, are owned by or licensed to Care Studios, its affiliates, artisans, collaborators, or other licensors, as applicable, and are protected by applicable U.S. and international copyright, trademark, and other intellectual property laws.

Care Studios works with independent artisans and artisan collectives whose original designs, creative works, techniques, names, stories, and other intellectual property may remain the property of the respective artisan, collective, creator, or rights holder. Nothing in these Terms transfers ownership of such intellectual property to Care Studios or to users of the Services.

These Terms permit you to access and use the Services for your personal, non-commercial use only. Unless you have received prior written permission from Care Studios or the applicable rights holder, you may not reproduce, copy, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or otherwise commercially use material appearing on the Services.

Nothing in these Terms grants you any license or other right to use any copyright, trademark, design, photograph, artwork, product design, or other intellectual property belonging to Care Studios, our artisans, collaborators, Shopify, or any third party, except as expressly permitted in these Terms. Unauthorized use may violate applicable intellectual property laws. All rights not expressly granted are reserved by their respective owners.

The Care Studios name, logo, and other Care Studios branding are trademarks or intellectual property of Care Studios or its applicable affiliates or licensors and may not be used without prior written permission.

The names, designs, artwork, and other intellectual property associated with individual artisans, artisan collectives, collaborators, or third parties remain subject to the rights of their respective owners and may not be reproduced or commercially used without appropriate authorization.

Shopify's name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other trademarks, names, logos, product names, designs, and slogans appearing through the Services belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

To the fullest extent permitted by law, Care Studios is not responsible for any loss, damage, or other issue arising from your use of optional third-party tools or services that are not operated or controlled by Care Studios.

Care Studios is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Care Studios. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Care Studios.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

You agree to indemnify, defend and hold harmless Care Studios, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You and Care Studios consent to venue and personal jurisdiction in such courts.
